An effort for removal of doubts about AIASC

Dear HSG-II/ HSG-I/ HSG-I (NFG) members and companions!

 

As per  Dte's OM No.13-01/2020-SR dated 20-04-2020, the last date to file nomination for new union / association was on 31.05.2020.

 

As per DoPT classification of posts after 7th CPC is:-

 

Pay matrix 9 & above is Class-A

Pay matrix 6, 7 & 8 is Class-B

Pay matrix 1 to 5 is Class-C

 

            We applied for separate category and association for HSG-II / HSG-I / HSG-I (NFG) having pay matrix 6, 7 & 8 which falls under Group ‘B’ (Non-Gazetted).

 

            After scrutinizing our Application, Constitution, Memorandum and list of estimated members, the Postal Directorate has allowed us to participate in the membership verification 2020 as "All India Association of Supervisor Cadre (Gr. B). 

            Further,  Shri R.N. Prashar, Secretary General,  NFPE wrote to the Directorate  and claimed HSG-II, HSG-I &  HSG-I (NFG) belong to Group ‘C’ category as per earlier categorization of DoP for their commonality and homogenous nature and insisted the Postal  Directorate to cancel nomination of AIASC.  

 

            It has created a little confusion amongst existing HSG-II, HSG-I &  HSG-I (NFG)  members /officials.  A detailed inquiry with the Postal Directorate (SR Section) was made in this regard and also about the category of erstwhile separate Association for Supervisor (General Line) which reveals that-

 

            As per Postal Directorate OM F. No. 13-01/2020-SR   dated 03-03-2020, there was no separate union/association in the Gr-B Category, i.e.  HSG-II, HSG-I & HSG-I (NFG) existed in the DOP.

 

        Only AIASC applied for such Group ‘B’ Category, i.e.  for HSG-II, HSG-I & HSG-I (NFG) officials. Scrutinizing all of our documents and in consultation with DoPT, the Postal Directorate decided to allow HSG-II, HSG-I & HSG-I (NFG) officials  in the process of verification of membership under AIASC  vide OM File No. T-15/2/2020-SR dated 24-07-2020.

 

            It is pertinent to mention here that the power /responsibility of defining any ‘distinct category’ had been delegated to the Ministry / Department as per Point of Doubt 3 clarified in the DOPT OM No 2/2/94 - JCA dated 22-04-1994. Naturally, nothing (any representation) even court cases can be fruitful against such decision.

 

          The Postal Directorate OM  F. No. 13-01/2020-SR   dated 03-03-2020 was issued in supersession of all earlier order. As such, the erstwhile ‘distinct category’ for separate Association for Supervisor (General Line) which consisted of LSG (including TBOP Officials), HSG-II (including BCR Officials) and HSG-I officials of Post Offices has automatically been dismantled because as on 03-03-2020, it had not the protection for maintaining ‘Status Quo’ as per order of the Hon’ble High Court of Delhi dtd 06-05-1997 in C.W.P. No 1827/97 as the case (Writ Petition)  was transferred to the Hon’ble CAT, Principal Bench in New Delhi vide TA No 12/2015 and ultimately DISMISSED on 27-07-2019.         So there is no any chance for revival of erstwhile ‘distinct category’ for separate Association for Supervisor (General Line). Any court cases for its revival will definitely yield ‘Tarikh-pe-Tarikh” and ultimately “DISMISSAL” because the departmental order was a valid one.

 

        There will be approximately one week available for Online Verification of Membership in the Employee Portal (SAP) under individual Log in. Before this exercise, the Postal Directorate will issue necessary Office Memorandum wherein each ‘distinct category’ and name unions / associations those are finally going to participate in the Online Verification of Membership-2020 will be clearly mentioned. In this regard  Recommendation of the Committee for suggesting modification and better system in verification process for recognition of Associations  ( Online Verification of  Membership-2020) vide the Postal Directorate OM No F No 09-01/2018-SR dated 01-06-2020 is given hereunder in the following link:

So friends……

 

        It is clear path for us without any confusion/ hesitation. The Postal Directorate is favouring us at this crucial time. We should step forward with clear mind & vision that only AIASC is the “Sun of Liberty” for all HSG-II/HSG-I/HSG-I (NFG) officials who cannot become members of any existing Group ‘C’ unions anymore and all the HSG-II/ HSG-I/ HSG-I (NFG) officials are cordially invited to join AIASC irrespective of any earlier difference/ bitterness, if any, with a view to boost the power of unity and contribute in the process to rise AIASC for mutual service benefit of all of us.

An open letter on irrational request of NFPE against AIASC vide letter No PF/NFPE/ Verification of Membership dated 31.07.2020 w.r.t the Director (SR & Legal) letter No T25/2/2020 – SR dated 24-07-2020 regarding Verification of Membership - 2020

 

We, the non-gazetted Group B officials [HSG II, HSG I and HSG I (NFG)] are very thankful to the Department for allowing us to participate in membership verification for the year 2020 as  All India Association of Supervisor Cadre (Gr-B).

 

            We reached out to the NFPE letter in reference which is viral in social media and against the interests of this association and pointed out two basic issues to counter the validity of their claims.  

(a)               NFPE has requested the department to reject the formation of AIASC(Gr-B) on the condition that AIASC is against the ‘commonality and homogeneousness’.  Is this condition applicable to HSG II, HSG I and HSG I NFG group of officials only and not for other associations?

(b)               The department listed 31 associations and NFPE has objection for AIASC (Gr-B) only.  That means NFPE agrees that the remaining 29 associations are not against but above the theory of ‘commonality and homogeneousness’.

 

This association would like to bring the following facts to the kind notice of all concerned against such purported plea of the NFPE that not to allow the AIASC (Gr-B) to participate in Membership Verification-2020.

 

It is logically doubtful as to whether the Federation understands the meaning of ‘commonality and homogeneousness’ in true spirit. In reality, they are static and both of their vision and views are also static. That is why, they are not in position to respond to the changes that has been going on in the department since last three decades.

The DOP vide letter No 13-1/93-SR dtd 10-08-1994 defined ‘distinct categories’ of its various employees among which ‘Group-C staff’ was a category.

At that point of time, it was a broad category and even HSG-I was classified as “General Central Service, Non-Gazetted Ministerial Group-C”. Naturally, Postal Assistants, LSG, HSG-II & HSG-I employees were the part of the then Group-C. But now, HSG-II and above are classified as “General Central Service, Group-B, Non-Gazetted Ministerial”. In question of ‘commonality and homogeneousness’, there is vast difference between Group-C and Group-B employees, i.e., ‘commonality and homogeneousness’ don’t exist at all between these two distinct groups. Hence, the  Department has now taken an appropriate decision by making a separate category of Group-B Non-Gazetted employees.

 

 Interestingly, the Secretary General, NFPE has mentioned a Point of Doubt 3 clarified in the DOPT OM No 2/2/94 - JCA dated 22-04-1994 to establish his theory of ‘commonality and homogeneousness’ in his golden day-dream but forget to mention the last line of the same clarification that “The responsibility of defining ‘distinct category’ has been left to the concerned Ministry/ Department”

                And accordingly the Department has taken suitable decision which is fit to present day’s essentially because everything in this world is relative .
